Terms of Service

These Terms of Service ("Terms") govern access to and use of GeoScale's websites, dashboard, APIs, documentation, integrations, and related services (the "Services").
By creating a GeoScale account or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. In these Terms, "Customer" and "you" refer to the person or organization using the Services.
1. About GeoScale
GeoScale is a business registered with the Dutch Chamber of Commerce (KVK) under number 42141024 and VAT identification number NL005529266B07.

2. Business and professional use
The Services are intended for use in connection with a trade, business, craft, or profession. They are not offered for private consumer use.
By creating an account or using paid Services, you represent that you are acting for business or professional purposes and not as a consumer.
Registration is self-service and does not require prior approval by GeoScale.
3. Accounts and security
You are responsible for providing accurate account and billing information and for keeping your account credentials and API keys secure.
API keys may be created, renamed, and revoked through the GeoScale dashboard. You must promptly revoke credentials that are no longer required or that you know or reasonably suspect have been compromised.
You are responsible for activity and billable usage performed using credentials issued to your account, except to the extent that such activity results directly from a security failure for which GeoScale is responsible.
GeoScale may, at its sole discretion, waive or credit charges in exceptional circumstances. Doing so does not create an obligation to provide the same treatment in another case.
4. The Services
GeoScale provides geographic-data services including address search, autocomplete, validation, and related functionality.
Current API functionality, supported countries, endpoints, technical requirements, and usage limits are described in the GeoScale documentation.
The documentation may evolve as the Services change. GeoScale does not guarantee that a particular country, dataset, endpoint, or feature will remain available indefinitely.
5. API stability and changes
GeoScale aims to keep published stable API versions backwards compatible. Where a substantial breaking API change is necessary, GeoScale will ordinarily introduce a new API version rather than materially changing an existing stable version.
This does not prevent GeoScale from making non-breaking changes, fixing defects, addressing security issues, or making changes required by law, upstream datasets, or infrastructure dependencies.
Where reasonably practicable, GeoScale will provide advance notice of changes that materially remove or impair existing paid functionality.
6. Permitted use
Subject to these Terms, you may integrate the Services into your own websites, applications, ecommerce stores, software products, internal systems, and services provided to your customers.
You may store or cache results returned by the Services where reasonably necessary for your own application or business processes, subject to applicable law and any rights that apply to the underlying source data.
Unless GeoScale has agreed otherwise in writing, you must not:
- Resell, sublicense, or redistribute access to the GeoScale API as a standalone or substantially equivalent service
- Resell or distribute GeoScale API credentials to third parties
- Systematically scrape, harvest, enumerate, or extract results for the purpose of reconstructing a substantial portion of GeoScale's database or creating a substantially equivalent address-data service
- Circumvent authentication, rate limits, billing mechanisms, access controls, or other technical restrictions
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services or related infrastructure
- Conduct unauthorized vulnerability testing or security probing
- Use credentials belonging to another customer without authorization
- Use the Services for unlawful purposes
- Use the Services in a way that infringes the rights of GeoScale or any third party
These restrictions do not prevent ordinary automated API usage, which is an intended use of the Services.
7. Rate limits
API usage is subject to the rate limits and other technical limits described in the GeoScale documentation.
GeoScale may reasonably modify those limits to protect service availability, security, infrastructure, or fair access to the Services.
8. Usage-based billing
The Services are billed on a usage basis. Current prices and applicable billable units are described on the GeoScale pricing page or in a separate written agreement.
A billable API request is a request to a metered API endpoint that GeoScale successfully processes and records as usage.
Requests that are rejected because of missing or invalid credentials, an ineligible subscription, rate limiting, an invalid request, or a GeoScale server-side error are not billed.
Repeated or retried successful requests are separate billable requests, even where they contain the same query or result from retry logic in your software.
GeoScale measures usage through its own systems and periodically transmits metered usage information to its billing provider. Reporting and billing information may therefore appear with a delay.
Unless GeoScale expressly provides or agrees to a usage or spending limit, use of the Services is uncapped. You are responsible for monitoring your usage and resulting charges.
9. Invoicing and payment
Usage is billed monthly through Stripe. You authorize GeoScale and Stripe to charge the payment method associated with your account for amounts due.
Prices exclude VAT and other applicable taxes unless expressly stated otherwise. You are responsible for providing accurate business, billing, and VAT information.
Charges for usage already incurred are non-refundable, except where required by law or where GeoScale determines that a billing or metering error occurred.
If you believe an invoice or usage calculation contains an error, you should notify GeoScale without undue delay and preferably within 30 days after the relevant invoice, providing enough information for GeoScale to investigate.
10. Failed and overdue payments
If a payment fails or an amount becomes overdue, GeoScale or its payment provider may retry collection and notify you of the failed payment.
GeoScale may restrict or suspend access to the Services while amounts remain overdue. Usage incurred before access is suspended remains payable.
11. Cancellation and account deletion
You may cancel the Services at any time through GeoScale Dashboard.
Cancellation disables further paid API usage immediately. You remain responsible for all usage incurred before cancellation, including metered usage that is transmitted to Stripe or appears on an invoice after cancellation.
Cancelling the Services does not automatically delete your account. An eligible account may later reactivate paid access through the dashboard.
To request deletion of your account and associated personal data, contact support@geoscale.io. Certain information may be retained where required by law or reasonably necessary for legitimate purposes described in the Privacy Policy.
12. Geographic data and accuracy
GeoScale is designed to reflect address and geographic information obtained from authoritative public sources and aims to incorporate updates promptly after they become available to GeoScale.
GeoScale does not independently certify the legal existence, deliverability, occupancy, ownership, or suitability of an address. Source datasets may contain errors, omissions, inconsistencies, or delays, and GeoScale cannot guarantee that upstream information is complete, current, or error-free.
A result returned or recognized by GeoScale does not necessarily mean that mail, parcels, persons, or services can be delivered to the relevant address.
Information returned by GeoScale must not be treated as official legal proof of residence, ownership, occupancy, boundaries, or other legal status.
13. Safety-critical use
The Services are not designed or warranted for emergency response, emergency dispatch, medical or other safety-critical systems, or uses in which incorrect or unavailable geographic information could reasonably result in death, personal injury, or serious physical damage.
You must not rely on the Services as the sole source of information for such purposes.
14. Customer data
You retain your rights in data and other information that you submit to the Services.
You grant GeoScale the limited rights necessary to process that information solely to operate, secure, support, and provide the Services and to comply with applicable law.
GeoScale does not use the content of your address queries for advertising or to train ranking models or other machine-learning models.
You are responsible for ensuring that information submitted through the Services is processed lawfully and that you have any rights or legal basis required to provide it to GeoScale.
Where GeoScale processes personal data on your behalf, the Data Processing Agreement applies.
15. Intellectual property
GeoScale and its licensors retain all rights in the proprietary software, APIs, documentation, interfaces, branding, database structures, and other materials forming part of the Services.
Underlying public and third-party geographic datasets remain subject to their respective legal status, licenses, and rights. More information is available on the Data Sources page.
No rights are granted except those expressly stated in these Terms or required by applicable law.
16. Availability, maintenance, and status information
GeoScale provides the Services on a best-effort basis and uses commercially reasonable efforts to maintain reliable availability.
No particular uptime percentage, response time, recovery time, or other service level is guaranteed unless GeoScale expressly agrees to it in a separate written service-level agreement.
GeoScale may perform maintenance, updates, deployments, and infrastructure changes that temporarily affect availability. GeoScale aims to minimize service disruption where reasonably practicable.
Current and historical operational information may be published on the GeoScale Status Page. Status information is provided for convenience and does not constitute a contractual service-level commitment.
17. Upstream data and third-party dependencies
Parts of the Services depend on government datasets, public data sources, infrastructure providers, payment providers, and other third-party systems outside GeoScale's control.
If an upstream dataset or dependency is discontinued, restricted, materially changed, relicensed, made commercially impractical, or otherwise becomes unavailable, GeoScale may modify, replace, or discontinue the affected functionality.
GeoScale will use reasonable efforts to provide advance notice of a material discontinuation where circumstances permit.
18. Suspension
GeoScale may restrict or suspend access to some or all of the Services where reasonably necessary because of:
- Overdue payment
- A material breach of these Terms
- Fraud or suspected fraud
- Unlawful use
- A security threat or compromised credentials
- Abusive or disruptive usage
- A threat to the stability or security of the Services
- A legal or regulatory requirement
Where circumstances reasonably permit, GeoScale will notify you and provide an opportunity to remedy an ordinary remediable breach before suspension.
GeoScale may act immediately where delay could create a material security, legal, fraud, or operational risk.
19. Termination and discontinuation
Either party may terminate the agreement in accordance with these Terms.
GeoScale may terminate an account immediately for a material breach that cannot reasonably be remedied, repeated material breaches, fraud, deliberate abuse, unlawful activity, or serious security misconduct.
GeoScale may discontinue the Services as a whole. Where reasonably practicable, GeoScale will provide at least 30 days' advance notice before doing so.
Advance notice may not be possible where continued operation becomes unlawful, technically impossible, materially insecure, or dependent on an upstream service or dataset that becomes unavailable without sufficient notice.
20. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as available" and best-effort basis.
GeoScale does not warrant that the Services will always be available, uninterrupted, error-free, complete, or suitable for a particular purpose, or that geographic information obtained from upstream sources will always be accurate or current.
Nothing in these Terms excludes warranties or obligations that cannot lawfully be excluded.
21. Liability
To the maximum extent permitted by applicable law, GeoScale is not liable for indirect, incidental, special, or consequential losses, including loss of profit, revenue, anticipated savings, business opportunity, goodwill, reputation, or business interruption.
GeoScale is not liable for loss or corruption of data to the extent that the loss could reasonably have been avoided by maintaining appropriate backups or fallback procedures.
GeoScale's total aggregate liability arising out of or relating to the Services is limited to the amounts paid or payable by you to GeoScale for the affected Services during the 12 months immediately preceding the event giving rise to the claim.
The exclusions and limitations in this section do not apply where, and to the extent that, liability cannot lawfully be excluded or limited, including where mandatory law provides otherwise.
You must notify GeoScale of a claim within a reasonable period after becoming aware of the circumstances giving rise to it and provide reasonable information necessary to investigate the claim.
22. Third-party claims
You will indemnify GeoScale against third-party claims and reasonable resulting costs to the extent that they arise directly from:
- Your unlawful use of the Services
- Data or materials that you submitted without having the rights or lawful basis required to do so
- Your material infringement of a third party's intellectual property or other legal rights through your use of the Services
This obligation does not apply to the extent that the relevant claim was caused by GeoScale.
GeoScale will provide reasonable notice of a covered claim and reasonable cooperation in its defense.
23. Force majeure
Neither party is liable for delay or failure to perform an obligation, other than an obligation to pay amounts already due, to the extent caused by circumstances beyond its reasonable control.
Such circumstances may include major internet or telecommunications failures, widespread infrastructure outages, power failures, natural disasters, war, civil unrest, government action, labor disruption, widespread cyberattacks, or failure of a critical supplier or public data source that could not reasonably have been avoided.
24. Pricing changes
GeoScale may change its pricing from time to time.
For existing customers, GeoScale will provide at least 30 days' advance notice of a material price increase unless the customer expressly agrees to an earlier change.
Price changes apply prospectively only. Requests made before a new price becomes effective will not be retroactively repriced.
If you do not agree to a pricing change, you may stop using and cancel the Services before the new pricing takes effect.
25. Changes to these Terms
GeoScale may update these Terms to reflect changes to the Services, applicable law, security requirements, or business practices.
Editorial changes, corrections, and changes that do not materially reduce your contractual rights may take effect when the updated Terms are published.
GeoScale will provide at least 30 days' advance notice of changes that materially and adversely affect existing customers' contractual rights or obligations, unless an earlier change is reasonably necessary to comply with law, address an urgent security issue, or respond to circumstances outside GeoScale's reasonable control.
If you do not agree to a material change, you may stop using and cancel the Services before it takes effect. Continued use of the Services after the change takes effect constitutes acceptance of the updated Terms.
26. Notices and communications
GeoScale may send contractual, billing, security, and service notices to the email address associated with your account.
You are responsible for keeping that email address current.

27. Assignment
You may not assign or transfer your agreement with GeoScale without GeoScale's prior written consent, except as part of a genuine corporate reorganization where the successor assumes your obligations under the agreement.
GeoScale may assign or transfer the agreement as part of a reorganization, incorporation, merger, acquisition, sale of business, or transfer of the GeoScale business or substantially all relevant assets, provided that the successor assumes GeoScale's applicable obligations.
28. Governing law and disputes
These Terms and the agreement between GeoScale and you are governed by Dutch law, without regard to conflict-of-law rules that would require application of another law.
Before commencing formal proceedings, each party will make reasonable good-faith efforts to resolve a dispute directly with the other party.
Subject to any jurisdiction that cannot lawfully be excluded, the courts of the Netherlands have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
29. General provisions
These Terms, applicable pricing, the Data Processing Agreement where applicable, and any additional terms expressly agreed in writing form the agreement concerning the Services.
If a separately signed agreement conflicts with these Terms, the separately signed agreement prevails to the extent of that conflict.
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
A failure or delay by either party to enforce a right does not waive that right.
Headings are provided for convenience and do not affect interpretation.
The English version of these Terms is authoritative. Any translation provided in the future is for convenience unless GeoScale expressly states otherwise.
